Language notice: The English version of these Terms of Use is the official and controlling text. The Ukrainian translation is provided for convenience. In case of any discrepancy, conflict, or misalignment between the English and Ukrainian versions, the English version prevails.

1. Agreement

These Terms of Use ("Terms") govern your access to and use of the Bright Kids iOS mobile application (the "App") and related services provided by BRIGHT KIDS UKRAINIAN ONLINE SCHOOL LLC ("Bright Kids," "we," "us," or "our") at https://brightkids.online.

By creating an account or using the App, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the App.

Eligibility: You must be at least 18 years old and a parent or legal guardian (or an adult student enrolling for yourself) to create an account. By accepting these Terms on behalf of a student, you represent that you have authority to do so.

2. Services Description

The App is an information and enrollment hub for Bright Kids Ukrainian Online School. It provides:

• Information about courses, teachers, schedules, pricing, and the school
• Account registration and profile management (including student profiles you create)
• Trial lesson registration and contact forms
• Links to official social media, messaging channels, and the website

Not included in v1 of the App: in-app payment processing, refund handling, attendance billing, or live class delivery. Those matters are governed by separate school policies and arrangements outside the App. Payment-related terms are not part of these Terms at this time.

Online classes themselves are provided by Bright Kids under separate educational arrangements communicated by the school, typically on third-party platforms (for example, video-conferencing tools), not inside the App.

3. Account Registration and Security

• You may sign in using Sign in with Apple, Google, or Facebook, as offered in the App (Apple Sign-In is required when other social logins are offered, per platform rules).
• You must provide accurate information and keep your account secure.
• You are responsible for activity under your account.
• You must accept these Terms and acknowledge our Privacy Policy during onboarding before your profile is saved.
• Before adding student information, you must provide parental consent as prompted in the App.

We may suspend or terminate accounts that violate these Terms or applicable law.

4. Acceptable Use

You agree not to:

• Use the App for unlawful purposes
• Provide false or misleading information
• Attempt to access other users' accounts or our systems without authorization
• Upload malware, spam, or abusive content through forms
• Impersonate another person or misrepresent your relationship to a student
• Scrape, reverse engineer, or misuse the App except as permitted by law

5. Intellectual Property

All content in the App and on the Website — including text, logos, course descriptions, images, and branding — is owned by Bright Kids or its licensors and protected by intellectual property laws.

You may not copy, modify, distribute, or create derivative works without our prior written consent, except for personal, non-commercial use of information displayed in the App.

6. Educational Services Disclaimer

Bright Kids provides online educational services separately from the App. The App helps you learn about offerings and register interest (e.g., trial lessons). It does not:

• Guarantee availability of specific courses, teachers, or time slots
• Guarantee enrollment acceptance, class placement, or scheduling outcomes
• Deliver live instruction, grading, or attendance tracking
• Replace separate agreements, policies, or communications from the school about paid enrollment

Class quality, scheduling, teacher assignment, and enrollment decisions are solely managed by the school according to its operational policies. Your use of the App does not create a binding enrollment contract.

7. Third-Party Services

7.1 Login services

If you use Apple, Google, or Facebook to sign in, your use of those services is governed by their respective terms and privacy policies. We receive only the information they share with us (typically name, email, and a user identifier) as described in our Privacy Policy.

We are not responsible for third-party login platforms' practices, availability, or security.

7.2 Communication and social links

The App may link to Messenger, SMS/iMessage, Telegram, Viber, WhatsApp, social media pages (Facebook, Instagram, YouTube, TikTok, Telegram, and similar), and external websites. When you follow these links or open these channels, you leave the App and your use is governed by the third party's terms and privacy policy.

We do not control and are not responsible for the availability, content, security, or data practices of third-party messaging apps, social networks, or websites. Communications you send through those channels are between you, the provider, and school staff — not stored in the App unless you also use the in-app contact form.

8. Disclaimer of Warranties

THE APP AND CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the App will be uninterrupted, error-free, or free of harmful components.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BRIGHT KIDS AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE APP OR ANY THIRD-PARTY SERVICE LINKED FROM THE APP.

OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE APP SHALL NOT EXCEED ONE HUNDRED US DOLLARS (USD $100) OR THE AMOUNT YOU PAID US FOR APP-RELATED SERVICES IN THE TWELVE MONTHS BEFORE THE CLAIM, WHICHEVER IS GREATER.

Some jurisdictions do not allow certain limitations; in those cases, our liability is limited to the fullest extent permitted by law.

10. Governing Law and Disputes

These Terms are governed by the laws of the State of Texas, United States, without regard to conflict-of-law principles.

Any dispute arising from these Terms or the App shall be brought in the state or federal courts located in Travis County, Texas, and you consent to their jurisdiction.

11. Termination

You may stop using the App at any time and delete your account in Settings (see User Privacy Choices).

We may suspend or terminate your access if you breach these Terms, if required by law, or if we discontinue the App.

Sections that by nature should survive (including intellectual property, disclaimers, limitation of liability, and governing law) survive termination.

12. Changes to These Terms

We may modify these Terms. Updated Terms will be posted at https://brightkids.online/legal/terms with a new effective date. Material changes may require re-acceptance in the App.

Continued use after changes constitutes acceptance if re-acceptance is not required.
